Waterloo is a watershed decision on tent cities/neighbourhoods in distress which is the #1 issue facing local governments, BC Housing and the Province. Local governments seeking civil injunctive relief often show that they are doing their best to provide shelter accommodation through BC Housing. Mr. Justice M.J. Valente now denies the removal of a tent city until shelter beds are available. While some Justices in the BC Supreme Court have skirted around this issue due to concerns of judicial over-reach, Justice Valente has drawn a line in the sand. Ironically, Justice Valente relies on several BC Supreme Court decisions to link the requirement of shelter beds as a Section 7 Charter right and precondition before the removal of the encampment. This extends well beyond the scope of Adams and takes us into uncharted legal territory.
